General Terms and Conditions with Customer Information

1. Scope

These General Terms and Conditions (hereinafter “GTC”) of Grundschulkönig GmbH (hereinafter “Seller”) apply to all contracts for the delivery of goods and digital content, in particular to the educational materials offered on the websites “Grundschulkönig” and “Übungskönig”.

2. Conclusion of Contract

(1) The product presentations in the online shop do not constitute binding offers but serve to enable the customer to submit a binding offer.
(2) The customer submits an offer via the online order form. By sending the order, the customer makes a legally binding offer.
(3) The seller may accept this offer within five days by sending an order confirmation or by delivering the goods.

3. Right of Withdrawal

(1) Consumers have a statutory right of withdrawal. Details are provided in the seller’s withdrawal policy.
(2) For digital products, the right of withdrawal expires once execution has begun in accordance with § 356 para. 5 German Civil Code (BGB).

4. Prices and Payment Conditions

(1) All prices indicated in the online shop are total prices including statutory value-added tax.
(2) The available payment methods are listed in the online shop.

5. Delivery and Shipping Conditions

(1) Delivery takes place to the address specified by the customer.
(2) Digital content is provided to the customer via download or email.

6. Usage Rights for Digital Content

(1) All materials (worksheets, study booklets, collections, other products) are protected by copyright.
(2) By purchasing a digital product, the customer receives a simple, non-transferable right of use. The following license types apply:

  • Private License: Authorizes the use of the materials by a private individual in a home setting (e.g., for practice with their own children). Sharing with third parties is not permitted.
  • Teacher License (Single License): Authorizes individual teachers or tutors to use the materials in their own lessons, tutoring sessions, and to make copies for their own group of learners.
    Uploading the materials to digital learning environments (e.g., Padlet, Moodle, IServ, Teams or similar platforms) is permitted, provided that access is restricted exclusively to the teacher’s own class or group of learners.
    Sharing with colleagues, other tutors, an entire school, or in publicly accessible networks is not permitted.
  • School License: Authorizes an entire school or institution (e.g. primary school, secondary school, tutoring institute, learning center, or comparable educational institution) to use the materials for all teachers and learners within that institution. Distribution beyond the institution or commercial resale is not permitted.
    School licenses cannot be purchased online. Interested institutions are asked to send their request to shop@grundschulkoenig.de

(3) Any commercial use (e.g. resale, licensing, rental, publication in paid offers) is prohibited without express written permission.
(4) In the case of permitted sharing, the original design including logo and source reference (grundschulkönig.de) must be retained.
(5) By purchasing a digital product, the customer expressly waives the statutory right of withdrawal in accordance with § 356 para. 5 German Civil Code (BGB).

7. Retention of Title

Until full payment has been made, the goods remain the property of the seller.

8. Liability for Defects (Warranty)

Statutory warranty rights apply.

9. Liability

(1) The operators assume no responsibility for the accuracy or suitability of the materials for a particular purpose. Use is at the customer’s own risk.
(2) The seller is liable without limitation only in cases of intent or gross negligence, for injury to life, body or health, and under the provisions of the German Product Liability Act.

10. Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

11. Jurisdiction

The place of jurisdiction is the seller’s registered office, provided the customer is a merchant, a legal entity under public law, or a public-law special fund.

12. Alternative Dispute Resolution
